On September 22, a Case Management Conference was held (by video) to discuss and set dates for the various actions for moving the case forward. The following dates came out of the meeting:
Oct. 1, 2021 – Applicants’ affidavits
Dec. 10, 2021 – Respondents’ affidavits
Jan. 21, 2022 – Cross-examinations
Feb. 21, 2022 – Applicant’s Records due
April 1, 2022 – Respondents’ Records due
April 8, 2022 – Affidavits in response to intervenor motions due
* April 11, 2022 – Motion to extend the amnesty period
April 22, 2022 – Cross-examinations in support and/or opposing intervention due
April 29, 2022 – Motion record of parties responding to intervenor motion due
May 4,2022 – intervenor’s reply due
3 weeks from the decision on the inventors motion – intervenor to file materials (if granted status)
2 weeks later – parties to file written reply to intervenors’ submissions
Hearing date – will be five days, date TBD
* It does not appear that there is enough time to have a hearing on the merits and a decision from the court on or before the end of the amnesty period on April 30, 2022. Therefore April 11, 2022 has been set aside as a hearing date for a motion to extend the amnesty period past April 30, 2022.
